"For our statutory report this year, the Commission has examined whether the Environmental Protection Agency (EPA) is complying with its environmental justice obligations. Specifically, the Commission has reviewed EPA's compliance with Title VI of the 1964 Civil Rights Act, the Executive Order on Environmental Justice and EPA's use of the Resource Conservation and Recovery Act (which governs solid waste disposal and is also known as the Solid Waste Disposal Act) as an environmental justice tool to regulate the disposal of coal ash. The Commission chose to build off its prior evaluation of EPA's Title VI program and implementation of the Executive Order. At the same time, the Commission expanded the scope of review to include EPA's regulation of coal ash, because it represents an attempt by EPA to implement environmental justice principles as part of exercising its traditional statutory authorities. In the late 1980's, advocacy by a number of community groups as well as the publication of several studies, drew attention to the issue of disproportionate exposure of minority and low income communities to sources of pollution. Various labels were attached to this concept: 'environmental equity, ' 'environmental racism, ' and 'environmental justice.' The latter term has been adopted by EPA and also used in a Presidential Executive Order in 1994. Executive Order 12,898 requires federal agencies to collect data on the health and environmental impact of their activities on communities of color and low income populations, and develop policies incorporating the principles of environmental justice into their mission." |
